Reasoning of Judgement

On June 25-26 the Training on Form of the Judgement on Criminal Cases, its Reasoning and Stylistic Correctness is being conducted for assistants to judges at the High School of Justice.

The training is being conducted by Zaza Meishvili – Judge of Supreme Court of Georgia.

Within the framework of the training the participants are discussing the following issues: the meaning of reasoning of judgement, main rules to be considered while drafting a judgement, principles of form of judgement, general recommendations on reasoning of judgement, principles of evaluation of evidence, European Court of Human Rights Standards, accusation and qualification, plea agreement, basic aspects of judgement reasoning and separate cases to be considered while sentencing.

The event has been organized with support of the project financed by the European Union – Support to the Reform of Criminal Justice System in Georgia (which is being implemented by Austrian organization – Hyman Dynamics), the United States Department of Justice and Council of Europe’s project – Strengthening the Independence and Efficiency of Justice.

26 assistants to judges are taking part in the training from Tbilisi, Kutaisi, Batumi, Poti and Rustavi City Courts and Ambrolauri, Akhaltsikhe, Khelvachauri, Senaki, Mtskheta, Telavi, Ozurgeti, Zestaponi, Gurjaani, Zugdidi, Samtredia and Sighnaghi Regional Courts.

The training was conducted by using the manual created by the special commission established in 2014 at the Supreme Court of Georgia - Form of the Judgement on Criminal Cases, its Reasoning and Stylistic Corrections.

The training is envisaged by the Training Program 2015 for Sitting Judges and other Court Staff.
